What to Do When a Tenant Leaves Furniture Behind
This situation has two halves, and most properties handle the second one well and the first one badly. The removal is easy. The record is what matters later.

Document before you touch anything
The moment you open the unit and find furniture in it, take photographs. Wide shots of each room, then closer images of anything substantial. Date them, which most phones do automatically, and put them in the file before anything else happens.
The reason is that this is the one part of the sequence that cannot be recovered later. A former tenant disputing a deposit deduction, or claiming an item of value was disposed of, is arguing against whatever record exists — and a property with no photographs is arguing from memory.
It takes five minutes and it is the highest-value five minutes in the whole process.
When you can actually remove it
That depends on how the tenancy ended, what notice was given and Texas property law, and it is a question for your attorney rather than for a hauling company. The rules differ between a tenancy that ended by agreement, one that ended by notice, and one that ended through the courts, and getting it wrong exposes the property rather than the contractor.
What we will say plainly is what we do: this branch removes abandoned property once the property confirms in writing that it has lawful possession and instructs the work. We do not advise on when that point is reached, and any hauling company that offers to is giving legal advice it is not qualified to give.
If you are unsure, ask your attorney before the truck rather than after.
The sequence
- 1
Photograph everything, dated
Wide shots per room, then anything substantial. Before anything is moved.
- 2
Confirm your position
With your attorney if there is any doubt about possession. This is the step that protects the property.
- 3
Separate anything that looks valuable or personal
Documents, identification, photographs, jewellery. Those are handled differently and should not go on a truck by default.
- 4
Instruct the clearance in writing
Which unit, what goes, and confirmation you have possession. That written instruction is part of the record too.
- 5
Photograph the cleared unit
As-cleared images with the date, filed alongside the as-found ones. That pair is what settles a dispute.
- 6
Then start the turn
Cleaning, repair, paint. The clearance was the blocker; everything else can now run.
What we do about apparently valuable items
Crews set aside anything that reads as personal or potentially valuable — documents, identification, photographs, obvious valuables — rather than loading it, and tell the property. That happens even where the instruction said the unit was clear.
What then has to happen to that property is a legal question for you. It is not a judgment a hauling crew should be making on your behalf, and a crew that would make it is a liability rather than a convenience.
- Personal documents and identification set aside
- Apparently valuable items not loaded
- The property told rather than the decision made for them
- Dated photographic record provided on request

The record comes with the job
As-found and as-cleared photographs, dated, at no extra cost. It takes a crew two minutes and it is what settles disputes.
FAQ
Related questions
- When can I legally dispose of a tenant's belongings in Texas?
- That depends on how the tenancy ended and what notice was given, and it is a question for your attorney. We remove abandoned property once you confirm in writing that you have lawful possession — we do not advise on when that point is reached.
- What should I photograph?
- Wide shots of each room before anything moves, then closer images of anything substantial, all dated. Then the same rooms once cleared. That pair is the record.
- What happens if something valuable turns up?
- The crew sets it aside rather than loading it and tells you. What then happens to it is a legal question for the property, not a judgment for a hauling crew.
- How fast can the unit be cleared?
- Where an account is set up, usually within a day or two of your instruction. The bottleneck is normally confirming your position rather than crew availability.
